ServiceTarget PBC and its subsidiaries and affiliates (collectively,  the “ServiceTarget”, “we” or “us” or “our”) are committed to protecting the privacy of individuals who use our Services.  We may update this policy from time to time.  

For the purposes of this Privacy Policy (“Policy”), our “Services” refer to the on-demand customer service solution made available by ServiceTarget PBC (the “ServiceTarget Service”), as more completely described in our Terms of Service.

WHAT THIS POLICY COVERS:

The Services to which you and your Authorized Users (also referred as “Subscriber”) have subscribed or registered.

PERSONAL INFORMATION THAT YOU PROVIDE TO US

For the purpose of this Privacy Policy, "Personal Information” means data that can be used to uniquely identify or contact a specific natural person.

We collect only the minimum personal information necessary to operate, maintain and provide you the features and functionality of the Service, to analyze how the Service is used, diagnose service or technical problems, personalize content and remember settings to help you efficiently access your account, utilize the features and monitor the aggregate performance.

ACCOUNT INFORMATION:

When you register for a Service, we ask for personal information such as your name, address, phone number, e-mail address, as well as certain related information like your company name, your job function/title and website name.

By voluntarily providing us with Account Information, you hereby represent that you are the owner of such personal information or are otherwise authorized to provide it to us.

NON-PERSONAL INFORMATION THAT WE COLLECT

We may collect “non-personal information”. For the purpose of this Privacy Policy, “Non-Personal Information” means data in a form that does not permit direct association with any specific individual. The following are some examples of non-personal information that we may collect and how we may use it:

SERVICE DATA:

We collect and store information that is created, inputted, submitted, posted, transmitted, stored or displayed by you in the process of using our Services. Examples of Service Data include Guide Content, metadata attached to the Content and aggregated analytics data around the usage of the Content.

“Content” refers to self-service guides, contact options, alert messages helpful links, journeys, and other information, messages, text or data which are collected, stored, surfaced, and shared through the use of our Service.

LOG FILES FROM YOUR USE OF OUR SERVICES:

When you use the Service, our servers record information related to your use of the Service. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks, pages viewed, and other such information.

ANALYTICS INFORMATION FROM YOUR USE OF OUR SERVICE:

We collect and store aggregate analytics information pertaining to use of the Service. We define this information as Usage Data.  The purpose of such information is to help you analyze the performance of the Service and help you improve and evolve the Content.

HOW WE USE YOUR INFORMATION

We may use, transfer and disclose Non-Personal Information for any purpose. If we combine Non-Personal Information with personal information, the combined information will be treated as personal information for as long as it remains combined. ServiceTarget may use such combined information to provide and improve its products, services, content, and advertising.

SHARING PERSONAL INFORMATION

THIRD-PARTY SERVICE PROVIDERS:

We share information, including personal information, with our third-party service providers (such as credit card processors, managed hosting providers, sub-processors of Service Data, and technology partners) to provide the necessary hardware, software, networking, storage, and other services that we use to operate our Services and maintain a high-quality user experience. We do not permit our service providers to use the personal information that we share with them for any other purpose than in connection with the services they provide to us.

OTHER SERVICES:

You may choose to make use of Other Services in conjunction with our Services. Other Services are third party products, applications, services, software, products, networks, systems, directories, websites, databases and information which our Service links to, or which you may connect to or enable in conjunction with the Services, including, without limitation, Other Services which may be integrated directly into your Account to which you grant access privileges to your Account. When access is granted, certain information in your account is shared with the third party, including personal information. ServiceTarget does not control the policies and procedures of those services.

COMPLIANCE WITH LAWS AND LAW ENFORCEMENT REQUESTS; PROTECTION OF OUR RIGHTS:

We disclose personal information to respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. We may also share such information if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service, or as otherwise required by law.

ACCESSING AND UPDATING YOUR INFORMATION

Subscribers may access, update or change or request to delete Account Information they have provided by contacting us at privacy@servicetarget.com.

If you are a subscriber to the Services or authorized as an Authorized User under a subscriber’s account to the Services and would like to opt-out of getting marketing communications from us please contact us at privacy@servicetarget.com or follow the unsubscribe instructions included in each marketing email.

PROTECTION OF YOUR INFORMATION:

We are committed to ensuring the security of your personal information. We utilize robust precautions to protect the confidentiality and security of the personal information within our Service, by employing technological, physical and administrative security safeguards, such as firewalls and carefully developed security procedures. For example, when you enter confidential information (such as login credentials) we encrypt the transmission of that information using secure socket layer technology (SSL). These technologies, procedures and other measures are used in an effort to ensure that your Service Data is safe, secure, and only available to you and to those you authorized to access your Service Data. However, no internet, e-mail or other electronic transmission is ever fully secure or error-free, so you should take care in deciding what information you send to us in this way.

We’ve also adopted commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. For example, we regularly back up your data to help prevent data loss and aid in data recovery.

DATA HOSTING, TRANSFER AND RETENTION:

Unless we expressly agree otherwise, the ServiceTarget may host and process data needed for the Service to operate in the United States and in other countries through ServiceTarget and third parties that we use to operate and manage our Service.

We will retain data that is processed on behalf of our subscribers in accordance with the instructions received from our subscribers for as long as needed to provide our Services to our subscribers, subject to compliance with this Policy. We may retain and use other personal information, including personal information as set forth in this Policy as necessary to comply with our legal obligations, maintain accurate accounting, financial and other operational records, resolve disputes, and enforce our agreements as described above. Our policy for the deletion of Service Data following termination or cancellation of a subscriber’s subscription to the Service can requested by contacting privacy@servicetarget.com.

CHANGE OF CONTROL

The ServiceTarget may assign or transfer this Policy, and your Account and related information and data, including any personal information, to any person or entity that acquires all of our or substantially all of our business, stock or assets of, or with whom we merge.

CHILDREN’S PRIVACY

Our Service is not directed to persons under 13, and we do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register with the Service. If we become aware that we have collected personal information from a child under age 13 without verification of parental consent, we take steps to remove that information. If you believe that we may have any information from or about a child under 13, please contact us at privacy@servicetarget.com.

USERS OUTSIDE THE UNITED STATES

Certain policies and procedures have been enacted to comply with European Union laws governing data privacy (GDPR). The subscriber understands and agrees that this privacy policy may not comply with other foreign laws that may be specific to the country or region of the subscriber or Authorized Users under subscriber’s account.
